Cheap sushi comes at a cost – most outlets ripping off workers

Cheap sushi comes at a cost with a wage theft blitz across the country finding most outlets breaking workplace laws.

The Fair Work Ombudsman found 90 percent of audited businesses were non-compliant with laws relating to wage theft and also record keeping.

Fair Work investigated 45 sushi outlets in New South Wales, Queensland and the Australian Capital Territory.

Inspectors found 37 had underpaid their staff and 29 had breached pay slip and record keeping laws.

The regulator subsequently recovered a total of $746,203 for 397 workers who missed out on lawful hourly rates, penalty rates and overtime.

Inspectors also issued nine infringement notices attracting penalties totalling $17,850.

Furthermore, Fair Work issued 15 formal cautions and six Compliance Notices.

Businesses taken to court

Meanwhile, Fair Work took six of the businesses to court for serious breaches of workplace laws.

In two of those matters, the court ordered combined penalties of $136,250.

Three matters involving alleged underpayments at sushi outlets in Newcastle, the New South Wales Central Coast and Canberra are still before the courts.

Recently, the Federal Circuit Court imposed penalties of $36,000 against Lydia Chang for underpaying four migrant workers $33,225 at her ‘Sushi Revolution’ store in Newcastle.

Industrial advocate Miles Heffernan from said cheap sushi comes at a cost.

“This audit campaign proves once again that wage theft is rife in the fast food and hospitality industries,” he said.

“Almost all of the outlets were breaking workplace laws and ripping off their workers – it’s not acceptable.”

Meanwhile, Mr Heffernan called for governments to introduce criminal penalties for wage theft.

“Until we make wage theft a criminal offence, and start convicting and locking up greedy employers, they will continue to cut corners and steal from their workers, because it’s just too easy,” he said.
